Terms and Conditions (T&C) of KinkNet
1. Scope
These Terms and Conditions (T&C) govern the use of the platform KinkNet (hereinafter referred to as the “Platform” or “KinkNet”) by registered users (hereinafter referred to as “Users”). By using the platform, users agree to the following terms.
2. Use of the Platform
KinkNet is a community platform that allows users to explore their interests in kink, BDSM, and fetish in a safe, respectful, and consensual environment. The use of the platform requires users to comply with the applicable T&C, Community Rules, Profile Rules, and Chat and Messaging Rules.
3. Registration and User Account
(1) Registration is free but mandatory for the use of the platform.
(2) Each user is responsible for the truthfulness and accuracy of the information provided during registration.
(3) Users may only create one account per person. It is prohibited to register with multiple identities or false information.
(4) The sharing of login credentials with third parties is prohibited. The user is responsible for all activities carried out with their account.
(5) Members must be at least 18 years old to use this service. By signing up, users confirm that they are at least 18 years of age
4. User Obligations
(1) KinkNet expects all members to interact with each other in a respectful, consensual, and responsible manner.
(2) Users agree not to post any content that violates the Community Rules, Profile Rules, or applicable laws.
(3) Users must not disseminate discriminatory, offensive, or harassing content.
(4) Impersonating other users, falsifying identities, or engaging in “catfishing” is prohibited.
(5) Each user is responsible for securely managing their personal data and information. KinkNet accepts no liability for misuse or loss of login credentials.
5. Content and Copyright
(1) Users retain the copyright to any content they upload (e.g., images, texts, videos).
(2) By uploading content, the user grants KinkNet a non-exclusive, worldwide license to display, distribute, and store this content within the platform as long as the content remains visible.
(3) The user ensures that the uploaded content does not infringe on the rights of third parties (e.g., copyrights, trademark rights, or privacy rights).
(4) Posting content that is pornographic, offensive, or illegal, or that infringes upon third-party rights, is prohibited.
6. Profile and Chat Rules
(1) Profile pictures and content must not include explicit depictions of genitals, animals, children, or inappropriate representations of other people.
(2) Chat messages must not harass, aggressively request, or pressure other users. All interactions should be based on mutual respect and consent.
(3) KinkNet reserves the right to delete profiles or content that violate these rules.
7. Liability
(1) KinkNet is not liable for content created or uploaded by users. The responsibility for all uploaded content lies solely with the respective user.
(2) KinkNet is not liable for any direct or indirect damages arising from the use of the platform or interactions with other users.
(3) The use of the platform is at the user’s own risk. KinkNet makes no guarantee regarding the security or protection of personal data.
8. Termination and Suspension of User Accounts
(1) KinkNet reserves the right to suspend or delete user accounts if the T&C, Community Rules, or Profile Rules are violated.
(2) A user may delete their account at any time by doing so in their profile settings.
(3) In the event of account suspension or deletion by KinkNet, there is no entitlement to a refund for any fees, purchased content, or memberships (including the Uncut Membership), even if paid in advance.
(4) In the event of account suspension due to a breach of rules or Terms and Conditions, the user has no right to a refund or compensation for any content, memberships, or services purchased within the platform.
(5) KinkNet reserves the right to permanently deny access to purchased content for users whose accounts have been suspended.
9. Data Protection
(1) The collection, processing, and use of personal data is carried out in accordance with the Privacy Policy of KinkNet.
(2) KinkNet is committed to protecting the privacy of its users and complies with all applicable data protection laws.
(3) User data is only used for the purpose of providing and improving the platform.
10. Amendments to the T&C
(1) KinkNet reserves the right to amend these T&C at any time. Changes will be communicated to users in a timely manner and will take effect with the next use of the platform.
(2) Continued use of the platform after a change to the T&C constitutes acceptance of the new terms.
11. Final Provisions
(1) The laws of the country where KinkNet is based apply, excluding international private law.
(2) If any provision of these T&C is invalid, the validity of the remaining provisions will not be affected.
(3) The place of jurisdiction for any disputes related to the use of the platform is the location of KinkNet.
